You further grant the Licensed Parties the right to use your username, real name, image, likeness, caption, location, or any other identifying information associated with your User-Generated Content. By submitting content, you represent and warrant that:

1.  You own all rights to your User-Generated Content.

2.  You have obtained permission from any persons appearing in your content to grant these rights.

3.  You are not a minor and have the legal authority to grant these permissions.

4.  The Licensed Parties' use of your content will not infringe upon the rights of any third party or violate any laws.

By submitting content, you release, discharge, and agree to hold harmless Colorfulworld, its Licensed Parties, and any affiliates acting on its behalf from any liability relating to the use of your content. If you believe that any User-Generated Content on Colorfulworld's website infringes upon your rights, please follow the DMCA Notice & Takedown Procedure outlined below.

Termination and Accuracy of Billing and Account Information

A. Access/Account Termination

Colorfulworld reserves the right, at its sole discretion and without prior notice, to terminate, suspend, or restrict your access to our services, including your account, at any time and for any reason or no reason. If you violate any provision of this Agreement, we may immediately suspend or terminate your account, delete your profile, and deny access to our services, with or without notice. You acknowledge and agree that Colorfulworld is not liable for any damages or obligations arising from such termination, and you will not be entitled to a refund of any previously paid amounts, to the fullest extent permitted by law.

Additionally, we reserve the right to refuse, limit, or cancel any order at our discretion, including restricting purchases per individual, household, or order, as well as limiting sales to specific geographic regions or jurisdictions. These restrictions may apply to orders placed using the same customer account, credit card, billing, or shipping address. If an order is modified or canceled, we may attempt to notify you using the email, billing address, or phone number provided at the time of purchase. We also reserve the right to prohibit or restrict orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide and maintain accurate, current, and complete purchase and account information for all transactions on our website. This includes ensuring your email address, billing details, and credit card information remain up to date to facilitate order processing and communication. Failure to provide accurate account information may result in order cancellations, service restrictions, or termination of your account. B. Service Termination

These Terms of Service remain in effect unless and until terminated by either you or Colorfulworld. You may terminate this Agreement at any time by discontinuing your use of our services. However, all obligations and liabilities incurred prior to termination shall survive, including outstanding payment obligations. If we determine, in our sole judgment, that you have violated any term of this Agreement, we may immediately terminate your access to our services without notice. In such cases, you will remain liable for all amounts due up to the termination date and may be denied access to our services (or any part thereof).

  

Governing Law and Dispute Resolution

A. Governing Law

This Agreement and any disputes arising from or related to your use of Colorfulworld’s services shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflict of law principles. By using this website, you agree that any and all disputes between you and Colorfulworld, its successors, or assigns shall be exclusively resolved through binding arbitration, as set forth in this section.

B. Pre-Arbitration Dispute Resolution

If a dispute arises between you and Colorfulworld, you must first provide written notice of the dispute by email with a delivery receipt requested ("Notice") to welcome@colorfulworldelephantlight.com. The Notice must outline the nature and basis of the dispute and the specific relief sought ("Demand"). Both parties shall engage in good-faith negotiations to resolve the dispute within thirty (30) days of receiving the Notice or for a mutually agreed-upon extended period. If the dispute remains unresolved at the end of this period, either party may initiate arbitration.

C. Arbitration

If the dispute is not resolved through negotiation, it shall be exclusively settled by binding arbitration in Hong Kong. Arbitration is a more streamlined and private process than court litigation, utilizing a neutral arbitrator instead of a judge or jury. The arbitration may allow for more limited discovery and shall be subject to only limited review by courts. Arbitrators may award the same damages and relief as a court. By agreeing to these Terms, you and Colorfulworld expressly waive the right to a trial by jury and the right to participate in any class action lawsuit.

D. Exceptions to Arbitration

Despite the arbitration requirement, either party reserves the right to:

1.  Seek injunctive relief from a court of competent jurisdiction to prevent potential harm.

2.  File a claim in a Hong Kong small claims court, provided the dispute falls within the court’s jurisdiction.

E. Arbitration Process

Unless otherwise agreed in writing, arbitration shall be conducted before one arbitrator in Hong Kong or via video conference at the claimant’s election. The arbitration shall be governed by the rules and procedures of a recognized Hong Kong arbitration institution, as may be modified by this Agreement. The arbitrator shall have exclusive authority to determine disputes related to the interpretation, applicability, or enforceability of this arbitration agreement. 

F. Arbitration Fees

The party initiating arbitration shall be responsible for paying the administrative fees in accordance with the arbitration institution’s fee schedule. If the claim is valued at HK$120,000 or less, arbitration may be conducted based solely on written submissions. If the arbitrator determines that a claim is frivolous or filed in bad faith, all arbitration fees shall be governed by the rules of the chosen arbitration institution. The arbitrator’s decision shall be in writing, reasoned, and binding on both parties. Any information exchanged during arbitration shall remain confidential except as required by law.

G. No Class Actions

To the fullest extent permitted by law, you and Colorfulworld agree that claims must be brought on an individual basis only and not as a plaintiff or class member in any collective, consolidated, or representative proceeding.

H. Enforceability
